Terms of Service
Last updated: June 2026 · Whale Digital ConsultingPlain English, like everything else we do. These are the terms we work under when you engage Whale Digital Consulting for websites, apps, branding or related services.
Quotes & scope
- Every job starts with a written quote — a flat number in AUD, based on an agreed scope. No hourly surprises.
- If the scope changes mid-project, we'll tell you before any extra cost is incurred and re-quote the difference.
- Quotes are valid for 30 days.
Payment
- Build packages: 50% to start, 50% on launch, unless your quote says otherwise.
- Care and growth plans are billed monthly in advance and can be paused or cancelled with 14 days' notice.
- Prices shown on the site are indicative starting points; your quote is the binding number.
You own your site
- Once final payment clears, your website is yours: the design, your content, and the site's code are assigned to you. No lock-in, no exit fees — if you ever want to leave, we hand over everything in working order.
- One standard carve-out: tools, components and code libraries we built before your project (or that we reuse across clients) remain ours — you get a permanent, free licence to keep using them in your site. Open-source software stays under its own licence. This never limits your ability to run, move or modify your site.
- The domain is registered in your name from day one, so it's always yours.
- We may show the work in our portfolio unless you ask us not to.
Hosting
- Free hosting on a modern static stack is included with our build packages while you remain a Whale client.
- Domain registration fees are paid by you, in your name — so the domain is always yours.
Your content
- You're responsible for the accuracy and legality of content you supply (text, photos, menus, prices, claims).
- You confirm you have rights to any material you give us to publish.
Timelines
- We quote a delivery window with every project and we keep to it — provided content and feedback arrive on time from your side.
- Delays caused by missing content pause the clock, not the relationship.
Liability
- We build carefully, test thoroughly, and fix our mistakes free of charge.
- To the extent permitted by Australian law, our liability is capped at the amount you paid us for the work in question. Nothing in these terms excludes rights you have under Australian Consumer Law.
Governing law
These terms are governed by the laws of Victoria, Australia. If something goes wrong, we'll talk first — most things are solved with a phone call.
